This Privacy Policy applies to all users of Pollchat, including creators of polls, respondents participating in polls, panelists engaging in discussions, and visitors accessing our platform.

  3. Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. 
  • This Privacy Policy deals with information we collect in relation to our Platform and explains:

  2. How we collect and use that information,
  3. How you can provide information selectively, 
  4. How you can access and update this information, and 
  5. How we process, share and protect your information.

To provide Pollchat, we must process information about you. The type of information that we collect depends on how you use our platform. You can learn how to access and manage the information that we collect by visiting the settings within Pollchat.

2.1 Things that you and others do and provide:

  1. Information and content you provide: We collect the content, communications, and other information you provide when you use our platform, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content that you provide. Our systems automatically process content and communications that you and others provide to analyze context and improve our services as described below.   2. Data with special protections: You may choose to provide information about your preferences or other personal attributes which may be subject to special protections under applicable laws.
  3. Networks and connections: We collect information about the users that you interact with on our platform, as well as how you engage with them. We may also collect contact information if you choose to import it from a device, which we use for purposes such as helping you connect with others.
  4. Your usage: We collect information about how you use our platform, such as the types of content you view or engage with, the features you use, and the actions you take. This includes information about when you are active on our platform and what interactive activities you participate in.

Provide, personalize, and improve Pollchat: We use the information that we have to deliver Pollchat, including to personalize features and content (such as polls, direct messages, Moments, and interactive activities) and make suggestions for you (such as polls and topics that you may be interested in) within Pollchat. To create personalized experiences that are unique and relevant to you, we use your connections, preferences, interests, and activities based on the data that we collect and learn from you; how you use and interact with Pollchat; and the people, places, or topics that you engage with on Pollchat.
  2. Information across Pollchat and devices: We connect information about your activities on different features of Pollchat and devices to provide a more tailored and seamless experience across all Pollchat features that you use, regardless of the device. For example, we may suggest polls or interactive activities based on your previous engagement within Pollchat.
  3. Location-related information: We may use location-related information (if you’ve allowed us to collect it), such as your current location or the places you frequent, to personalize and improve Pollchat features and content for you, including polls and local events.
  4. Product research and development: We use the information we have to develop, test, and improve Pollchat, including by conducting surveys and research, and testing and troubleshooting new features.
  5. Ads and sponsored content: We do not display third-party ads on Pollchat. Any sponsored content or promotions within Pollchat are directly related to Pollchat features and activities.
  6. Providing measurement, analytics, and other business services: We use the information we have to measure the effectiveness of Pollchat features and understand how users interact with them, in order to improve our services.
  7. Promoting safety, integrity, and security: We use the information that we have to verify accounts and activity, detect and prevent spam and other harmful conduct, maintain the integrity of Pollchat, and promote safety and security on the platform.
  8. Communicate with you: We use the information that we have to communicate with you about Pollchat, including updates, new features, and to respond to your inquiries.
  9. Researching and innovating for social good: We use the information we have to conduct and support research and innovation related to Pollchat’s functionality and user experience.

 

4. How is this information shared?

When utilizing Pollchat, you have the ability to select the audience for your shared content, which may include groups, all of your connections, the general public, or a customized list of individuals. Actions taken on Pollchat, such as engagement with advertisements and sponsored content, may be visible to your network.

 Public information shared on Pollchat, including your username, publicly shared content,               information in your public profile, and interactions, can be viewed by anyone, whether they have a    Pollchat account or not. We, along with other Pollchat users, have the capability to provide access to or distribute public information to individuals both within and outside of Pollchat, including through search results, tools, and APIs. Public information may also be accessed, shared, re-shared, or downloaded via third-party services, such as search engines, APIs, offline media (e.g., television), and through applications, websites, and other services that integrate with our Products.

 

5. What do we mean by ‘Personal Data’?

Personal Data refers to any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

  1. Creator: Users who create and manage polls on our platform. 
  2. Respondent: Users who participate in polls created by creators. 
  3. Panelist: Users who engage in discussions or live chats on the platform. 
  4. Visitor: Users who visit the platform without signing in or participating actively.

We collect information from you in the following ways: 

  1. Directly from You: When you provide information through forms, surveys, and interactions on the Platform. 
  2. Automatically: Through tracking technologies like cookies, web beacons, and similar methods. 
  3. Third-party sources: When you use third-party services integrated with our Platform.

8.Cookies

  1. Cookies are small text files that are placed on your device when you use our Pollchat application. When you revisit Pollchat, these files are transmitted back to us, allowing our system to recognize your device. Cookies enable us to optimize Pollchat and enhance user experience.
  2. Upon visiting Pollchat, a popup message informs you of our use of cookies and implies your consent by continuing to use the application. If you choose not to allow cookies, you can deactivate and delete them at any time. However, disabling cookies may restrict access to certain features of Pollchat.
  3. Our application, online services, interactive features, messages, and advertisements may utilize “cookies”. These technologies help us understand user behavior, track visited sections of Pollchat, and measure the effectiveness of advertisements and searches.
  4. Information collected via cookies and similar technologies is treated as non-personal information. However, if Internet Protocol (IP) addresses or similar identifiers are considered personal information under local laws, we treat them accordingly.
  5. Likewise, if non-personal information is combined with personal information, we treat the combined data as personal information in accordance with this Privacy Policy.
  6. Ads delivered through our advertising platform may appear within Pollchat. To opt out of receiving personalized ads based on your interests, you can enable Limit Ad Tracking, which restricts the use of the Advertising Identifier (a non-personal device identifier). You may still see contextual ads based on your activities within Pollchat.
  7. We also use cookies and similar technologies to remember personal information and enhance your experience with Pollchat:
  • For example, knowing your preferences allows us to personalize your interactions within Pollchat.
  • Understanding your language preferences and user context helps us provide tailored services and content.
  • Recognizing user activity within Pollchat enables us to improve our advertising and communications relevance.
  • Personal details such as contact information and device identifiers assist us in providing personalized support and services.
  • Some of our communications may contain “click-through URLs” directing you to Pollchat content. Click-through data helps us gauge user interest and measure the effectiveness of our communications. If you prefer not to be tracked in this manner, avoid clicking on links in our email messages.

Responses from respondents and usernames associated with those responses are considered public data on the Platform. This information may be viewed by anyone who accesses the Platform.

We take reasonable steps to protect your personal data from unauthorized access, disclosure, alteration, or destruction. We are not responsible for breaches of security caused by third parties or events beyond our control, such as hacking, unauthorized access, or computer malfunctions.

Our Platform is not intended for children under the age of 12. We do not knowingly collect personal data from children.

  1. To manage and delete your polls and associated data.

  1. To manage and delete your chat history and discussions.
  • Visitor
  1. To request information about data collected during your visit.
  • Authorized Agent
  1. To act on behalf of a user regarding their privacy rights.

 

15. Disclaimer and Indemnity

    • Disclaimer

We cannot guarantee that your information will never be disclosed in ways not described in this Privacy Policy. You use the Platform at your own risk and are responsible for maintaining the confidentiality of your information.

  • Indemnity 

You agree to indemnify us against any third-party claims arising from your disclosure of information to third parties or your use of third-party services.

 

16.No Waiver

The rights and remedies available under this Policy may be exercised as often as necessary and are cumulative and not exclusive of rights or remedies provided by law. They may be waived only in writing specific to Pollchat. Delay in exercising or non-exercise of any such right or remedy does not constitute a waiver of that right or remedy, or any other right or remedy, within Pollchat.

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify users of any material changes.

 

18. Information Specific to Other Services

    • Tech Facts

Tech facts are published on an anonymous basis – that is, no Respondent Personal Information displayed in a Tech fact unless your Respondents authorize the use of their name and company affiliation. You are able to see the individual respondent’s identity in your account and, if you give a Jobifynn Technologies Private Limited employee permission to view that response, then Jobifynn Technologies Private Limited will also see this. However, we never publish or disseminate this information (unless you explicitly ask us to do so). 

We assign a unique identification number to each Tech fact. The ID will appear on each copy of the Tech fact. Our site is designed so that visitors may look up and view Tech facts without the collection of any personal information (except for such visitor’s internet protocol (IP) address)

  • Your Control Over Your Form Data

We store your form data (form content and responses) for you. You have the following controls over your form data:

  1. Download/backup your form data: We provide you with the ability to export, share and publish your form data in a variety of formats. This allows you to create your own backups or work with your data offline. See here for data exporting instructions.
  2. Delete your form data: You can delete your form data (including parts of forms, entire forms, and responses to forms) through your account’s user interface. See here for how to delete form entries.

We would like to emphasize that we will not use your form data to compete with you, market to your clients, or contact them for any other means of profit. We will also not sell your form data to anyone.
